QUESTION

Is the statute of limitations up on this harassment?

Asked on Mar 26th, 2013 on DUI/DWI - Michigan
More details to this question:
April 22, 2112. Police accident report does not match ambulance and ER report. Vehicle descriptions, number of vehicles, injuries, no injuries, condition of me, c-spine, no c-spine, no seat belt 55mph+, ER says no bruising, skin warm pink dry. No tamper proof blood alcohol done, report given as if drawn by outside person. I say abused. Moved around court rescheduled from criminal to traffic, still they want me to sign a paper taking responsibility for DUI, now with no injuries. Is the statute of limitations up on this harassment? I have Parkinson’s. Said they took DL, did not I still have, letter said driving privileges removed without hearing on Aug 4, 2012. Court appointed representative not representing me, just a processing tool for the county.

It sounds like the case was filed, if this is the case, the statute of limitations is not applicable. If you are unhappy with your court provided representation, you should consider seeking alternative counsel (read: private counsel) but that will cost you more that you are paying for representation. Many attorneys in your local area handle DUI cases, some of them may even do so exclusively, I encourage you to contact a private attorney to discuss your facts and what your goals are with the representation, it may not cost as much as you think to hire an attorney to help defend you.

In Michigan the Statute for most crimes is 6 years and they already have you in court so the Statute does not apply.
