QUESTION

Is there any chance an established attorney could fight this DWI and win?

Asked on Apr 26th, 2013 on DUI/DWI - Michigan
More details to this question:
I was driving and went the wrong way down a one way street. An ambulance saw me, and followed me until I pulled over. There were two ambulance drivers as witnesses. The police officer showed up while I was in the car, not driving, and issued me a DWI.

There is always a chance. I would need more information about the incident.

Yes, but you need to hire a DUI specialist, not a general practitioner of criminal defense.

They have witnesses that can show that you were driving and breaking the law. I suspect they can show that you had been drinking. The answer is NO.

Yes. You should investigate a competent DUI attorney to discuss the facts of your case and the avenues of defense that are available. Many times there are defenses relating to the alcohol measurements and the DUI investigation that do not relate to the driving. If you plead guilty, you will be found guilty.

The simple answer is there is always a chance to beat a DUI. More innocent people are charged with DUI than any other crime. There are always issues you can challenge regarding the stop, search, etc.

A good attorney can normally act to mitigate the damages, even if he cannot "win". Engage one now.
