QUESTION

Is there such thing as a DUI infraction ?

Asked on Feb 10th, 2013 on DUI/DWI - California
More details to this question:
I live in CA, and was given a ticket for vc 23136 DUI ZERO TOLERANCE LAW, but on the ticket it was considered as an infraction. I paid the fine online therefore I didn't see a judge and there were no AA classes ordered to me. Is this common? Or did I just luck out with just the suspension of license and no required AA classes.

VC 23136 is an infraction for zero tolerance of an under 21 person. So you didnt necessarily luck out. With a DUI attorney you potentially could have had won and not suffered the 1 year hard drivers license suspension, avoided fines and insurance premium increases.

DUI is normally a misdemeanor crime, with jail and fines. You got a break.

If you consider losing your license for a year, paying fines, being required to file an SR-22 once you are ready to relicense then yes. It is quite likely your blood alcohol concentration was below .05 which stretches the measurement capability of the breath test you probably provided. We have successfully handled many CVC?23136, you should consult a DUI attorney if you haven't plead guilty.
