QUESTION

What are my odds for getting a DUI charged reduced or dismissed?

Asked on Aug 14th, 2012 on DUI/DWI - Texas
More details to this question:
I was pulled over for rolling through a stop sign and immediately question because he "smelled" alcohol coming from my vehicle. I was asked several times whether I had been drinking and responded in the same fashion each time. "No sir." I was given three separate field sobriety tests, eye w/ light (did not move my head), walk the line (did not wobble), hold one leg up (did not wobble or fall) then I was asked to blow. I refused. I've been told as a CHL carrier always refuse. So I did so. He then searched my vehicle without asking and I was not in custody yet. When he arrested me for DUI I asked which portion of the sobriety tests I failed, he repeated "ma'am I am arresting you for DUI" over and over but did not answer. I was not given a breathalyzer at any time while in the car or at the police station. Do I have a chance at complete dismissal or maybe pleading no contest to a reckless driving?

Yes you have a chance, but you are going to need a respected DWI trial attorney.

Sounds like a defensible case, but no defense lawyer can tell you for sure what the prosecution will do in terms of a dismissal or reduction until he or she speaks with them. Until you get to trial everything depends on the prosecutor. Then everything depends on the jury. You need a good lawyer. Good luck.
