QUESTION

What are the consequences for my DUI arrest?

Asked on Jul 09th, 2013 on DUI/DWI - Michigan
More details to this question:
I was arrested for DUI in a Michigan state park and my ticket states I do not have to appear in court. So I'm wondering what consequences I will face besides the fine for the ticket? Is it guaranteed to be reported to the DMV and what will be the result of that?

You are wrong about not having to appear. Every DUI case in Michigan requires multiple Court appearances. Hire a local defense attorney and they can help you.

I never heard of a ticket for DUI that does not require going to court and I practice in Michigan. Is this listed as a charge or a warning? Did they take you and do a alcohol test on you? I need to know more.

I have never heard of being arrested for a DUI and not having to be in court. Ever. After an arrest for a DUI, you are taken to the police station and given a breathalyzer test. You should contact an attorney in the area where the State Park is and see what he/she says. The officer usually gives you a paper license after being arrested. You can't be convicted without going to Court and the ticket will say when you have to appear in Court.

If you received a misdemeanor ticket, you do need to appear in court, otherwise, a bench warrant will be issued. Talk to an attorney in Michigan to discuss this matter further and make sure it is handled properly.

A conviction for OUI First would result in fines and costs, costs of arrest and publication,of approximately $700 to $1500 and incarceration up to 90 days. Also suspension of your driving privilege, state driver responsibility and reinstatement fees and increased insurance costs. All told several thousands of dollars.
