What can happen if I failed a breathilizer while on probation?

More details to this question:
I went to court and was charged with a class 6 undesignated misdemeanor DUI on October 22, 2010. I have a 3 year probation term that ends in 30 days, but I failed the breathalyzer this morning when the SO came by the house, I blew a .03. All fines and fees have been paid and I have completed all the classes. I graduated from DUI Court in December 2012. Do I need a probation attorney?

you are on probation and you blew a .03, then you are in violation of your terms of probation. The judge could revoke your probation and order jail time.

They could decide to put you in jail because you flunked the test. Yes get a lawyer if they violate you.

Your probation can be revoked or extended. NO alcohol while on probation.

It's likely that all of your suspended jail sentence would be re-instituted. And yes, I would hire an attorney if I were you.

Probation only says no measurable amount of alcohol while driving it usually doesn't say you can't drink.
