QUESTION

What charges could my husband face for an accident when he already has a DUI charge?

Asked on Feb 17th, 2013 on DUI/DWI - California
More details to this question:
My husband was recently in an accident due to drinking and driving. He racked his car and hit a tree in a school yard. I am unsure of what he could possible be charged with. He has already had a DUI (driving under the influence) charge as a minor back in August 2012.

He could face another DUI and if there was any injuries to others then more serious charges.

He could be charged with felony DUI and face a jail sentence of 1 to 3 yrs. I strongly suggest that he hire an attorney.

You haven't provided enough information. If your Husband was a minor (under 18) in 2012, he is still under 21, if the case from 2012 is still open then he is not on probation and is likely facing less than if he is on probation and has a new case AND a probation violation. He should consult a DUI attorney for this case, he may have defenses and may be facing significantly more serious consequences if he is still under age, on probation or other variables that make his case more serious.

It depends if someone was injured (other than himself). If so, he could be facing a felony. He needs to hire a DUI specialist, and do it fast because he has only 10 days to save his license.
