What is the consequence for driving while suspended when suspension was from prior DUI?

More details to this question:
I have two DUI in less than three years. I have two jobs, three kids and one vehicle between me and my wife. Am I looking at jail time?

The penalty for driving while your license is suspended for DUI is a mandatory 60 days in jail. This is a very difficult charge to beat. I have been successful with it many times but it is very hard to defend. Make sure you have a good lawyer who has some experience with this type of charge.

Yes they may give you jail time. You should try to get your license back. This jail depends on the judge an your attorney. Your lawyer should try to limit what happens to you.

Yes. A 14601 VC charge with a prior comes with a minimum 5 day jail sentence (not much) but the real problem will be the probation violations which will will be filed. You need an attorney. 90 days would not be unreasonable. You could probably do the time on work release through the county jail. That will keep your job anyway.

If you were driving while suspended for DUI you are facing an additional license suspension of one and one half years and between 10 and 90 days in jail which can be served on the county sheriff's labor assistance program in which you are credited with serving one day for each eight hour day you spend in the sheriff's work program. After you do your work, you get to go home instead of jail. Usually, a ten day SLAP sentence is possible, using an attorney.

Absolutely. A second DUI within 10 years carries mandatory jail time. Your license will be suspended for 1 year at the DMV, and 2 years at court. You should hire a DUI specialist, who may be able to get the charge reduced, thereby deleting a lot of statutorily-required consequences. Do it soon because you have only 10 days to save your license. And your three kids won't mean a thing to the Judge!
