What is the punishment for being in a drunk driver accident as a passenger?

I did not drink, there was open containers in the trunk. I was in the car with the drunk driver and the car rolled over.

There are no penalties. Its not a crime to be drunk in a car as a passenger. Were you hurt? You may have great civil cases against insurance companies.
