Maybe, it depends on what records your background check reviews, you have a criminal conviction which will show up on any search that includes your criminal records. You may choose to have your record "expunged" which allows you to state that you have not been convicted of a crime to any private employer and some government employers (subject to some exceptions). A lawyer can help you explore that option. It may also show up on your driver license print out, that cannot be cleared by expungement.

Unless you have a conviction expunged, it will show up on a background check regardless of how old it is.

You do not specify where the DUI occurred, so I will assume it occurred in New Mexico. The answer to that is, it depends. It depends on who the employer is and what information they have access to. A 10 year old DUI conviction will probably appear on NCIC, a database maintained by the FBI, but that is only available to law enforcement officials. Most employers will not have access to the information contained in an NCIC report, but that doesn't mean you will be safe because there are other places where this information can be found. In New Mexico, there is a public website, www.nmcourts.gov/index , that provides information regarding criminal cases filed in most courts in New Mexico. You may want to go onto that website and see if you case appears on there. If your DWI occurred in Albuquerque, it was probably prosecuted in the Bernalillo Metropolitan courthouse, which has its own public database. You can check that database at www.metrocourt.state.nm.us/xnet. Those are the two main websites in New Mexico for criminal cases. There is no time limitation on them and cases as far back as the 1980's will appear on there. Unfortunately New Mexico does not have an expungment statute that removes old criminal records.
