Yes, all states share DUI info with each other, so the DUI that you got in 2007 will show up on your record in any state. If you just recently got another DUI in another state, the prosecutor and judge will be able to see the previous DUI on your record and this recent one will be considered your 2nd DUI.

It depends. Most other states have broader DUI statutes so a DUI in another state should not count. No prosecutor is going to give this to you. You need to find an attorney who knows how to fight this issue.
