Asked on Jan 21st, 2013 on DUI/DWI - Georgia
More details to this question:
I am going in for arraignment on Tuesday for driving without a license and driving on a suspended with alcohol in my system. I did not get a DUI but have previous convictions 3 total and my last one was little more than 3 years ago. I know I am facing jail time but I want to fight my case and see if I can get home confinement also will I go to jail at my arraignment.

Quite possibly, or the Judge will set bail. You should hire a lawyer, who can appear for you without you present, so it is less risky for you.

It would be rare, depending on what you state to the court. I would suggest to engage attorney immediately in order to minimize the chances and maximize your defense.

If you appear then the odds are that you will not go to jail at that time. Just get a lawyer and fight the matters.
