QUESTION

Will my DUI in one state count against me in another state?

Asked on Sep 30th, 2013 on DUI/DWI - California
More details to this question:
I just recently got a DUI in San Diego, CA. I just moved here from GA and I still have my GA driverโ€™s license. I have 3 DUI convictions in GA that are 5 or more years ago. Will these DUI count against me in CA? I understand that GA and CA do not share driverโ€™s info with each other. Does this matter?

It will if you don't fight it. In fact, it will be considered a FELONY DUI by California. Georgia is an operate and control state. Its DUI statute is broader than California's and can't be used as priors. But noones going to give that to you. In fact the prosecutor will try to put one over on you and the court. If you want to avoid this you have to get a DUI lawyer and fight it.

They could possibly be used if the prosecuting attorney finds the priors on a criminal history check (DUI's are not just on your driving record but also on a criminal record if reported) and the elements of Georgia's DUI law are the same as California's and they are within the past 10 years. It is a very good idea to have a lawyer in the area working for you in the event those priors are not found at first glance as the difference between a first offense and a fourth offense in California is a felony and significant jail time.

You must speak to an attorney about this, if you California knows about the DUI priors you may be looking at a 4th offense which would be a wobbler (meaning that the prosecuting agency can file it as a felony or a misdemeanor.this is a very serious matter.

Some states are linked up, some aren't. You need to hire a California DUI specialist, and do it soon because you have only 10 days to save your license.
