QUESTION

Can the school hold my child for detention without notifying me?

Asked on Jan 23rd, 2013 on Education Law - New Jersey
More details to this question:
My 3rd grader was held after school for detention (to complete missing assignments), and the school never notified me. I called them and was upset that they did this, and the teacher notified me that she has the legal right to hold my child after school without telling me.

If your child was supposed to be on the bus or left as a walking student, and the school was holding him, they need to notify you that he is remaining in school.  Usually the parents get called about that, it would be different if they called and said they could not reach you, but they are not allowed to simply hold the child for after school detention and not advise you - not in the third grade.
