My son is Dyslexic Dysgraphic and has CAPD, and the District refused to acknowledge it for years. His 504 plan fails him year after year. He is now in 5th grade and at a 2nd grade level. We paid for private evaluations but the district still refuses to follow the independent evaluations recommendations. They say his grades are good and test scores are good. They give him easier work and average it into.his 5th grade work to pull his grades up. He needs the Wilson reading program, OT and Speech. They are refusing to provide this. He is unable to write, and has a very low reading level. But has a very high IQ. Can they refuse to give him the appropriate services?

The school district must provide meaningful education.  you can make a demand that the child be evaluated and classified, and if the school refuses to do that, and you have private evaluations that say he should be classified instead of just having a 504, then you can require the district do to that.  You should consult with a education attorney that is familiar with the schools in your county.  Call my office if the matter is something in Ocean or Monmouth Counties.
