Is the the school responsible

More details to this question:
on Monday 9-15 my son who has a previous injury (Achilles tendon) in which he wears a boot has a pass to leave class early but the teacher was giving him a hard time got off the elevator the bell rang and was in the crowed of students and got kick in the injured foot causing him a great deal of pain and he went down injuring his back that hes not been to school.I saw the pediatrician and now trying to get appt. with ortho but no success yet .

I would wait to see if your son has any further injury.  it is very difficult to sue a school system, and the proof of liability and/or negligence is very high.  You need to put in writing what occured, and if necessary get the school to put a 504 plan in place which would provide an accomodation for your son's injury.
