QUESTION

Am I in a good position legally?

Asked on Aug 08th, 2016 on Elder Law - Florida
More details to this question:
A friend who is terminally ill contacted me and said that he wanted to give several firearms to me rather than his daughter because his daughter cared nothing about guns and she would only sell or pawn them. I made a hand written bill-of-sale listing the guns and noting that my friend was selling to me for one (1) Dollar. We both signed the bill. My friend recently entered a local hospital. He gave me the key to his apartment and told me to go to his home and take possession of the guns so his daughter and her friends could not get them and sell them. After I took possession, the daughter and her friend had a fit and demanded that I return them. I refused. The women now say they will go to the police and report me for taking advantage of my friend as he is ill and may have diminished capacity. I am not sure how strong or weak my position is. My friend and I are the same age.

With the bill-of-sale - it would seem to me you are in a good position.  A person is presumed to be competent and it would be up to them to prove he was not, if or when they take the case to Court.  Sometimes people threaten court action but when they discover the cost of even opening a court case, they don't move beyond threats.  There is really nothing to do unless or until you are notified of a court action.
