QUESTION

Death due to elder abuse

Asked on Jul 21st, 2014 on Elder Law - New Jersey
More details to this question:
My stepsister isolated and eventually hid my dad from myself and my sisters. We called APS in NJ and PA .He was drugged and hospitalized Mothers day 2013 and released only to be back in her midst. She was stealing his money and robbing his bank accounts. She was administering large doses of prescription narcotics to keep him in a stupor so her and her adult children could rob from his business. He owns 10 rental homes with thousands of dollars in monthly income. I contacted NJ state police on March 24th as we were refused contact with him via phone or in person. He was incoherant. I went the next day w/Pa APS to my stepsisters and i was sent away. 2 days later my dad was dead, the neighbor contacted me and he was sent DOA to the hosp as a John Doe while her and her kids gathered their story and hid the evidence. His autopsy showed several narcotics in his system at the time of his death.

First of all, I am very sorry for your loss.  Second, there are a lot of unanswered questions raised.  Did your dad die in NJ or PA?  If he lived in PA and was a resident of PA at the time of his death, you need to bring this matter to the PA courts.  If he lived in NJ and was a resident of NJ then you will need to bring it up in NJ.  Does he have a will? You should consider filing a caveat which is a document that will stop his will from being admitted to probate. Was your step sister the Power of Attorney for your dad? how did she have authority to do what she did?  You should also consider filing something that challenges the action she took while your father was alive, and seek to protect the assets in the estate.  My office is in Ocean County NJ.  I also work in Monmouth County.  Feel free to call if you think I can be of further help.
