QUESTION

Disabled Senior Needs Attorney

Asked on Apr 28th, 2015 on Elder Law - Texas
More details to this question:
A disabled senior who is blind/bed bound and has Multiple Chemical Sensitivities is refused accommodations from a JP Judge for a phone hearing. The rental management company has refused to allow tenant to stay in altered home after they purchased home in foreclosure. I am sorry, but everything about this case is both morally and ethnically wrong and needs a champion to help her. In looking for someone to represent her. I have become discouraged about your profession since this case is neither a money maker or a possible win case for some ones record. We have tried all possible avenues available to us to get her legal counsel over the last two years with no one willing to step up to the plate. I am hoping that one or two of you reading this will at least contact me and be willing to assist this person. I have gathered all info available on the case and can be a witness in the case. Thank you! Harvey Spears 214-630-4796

Thank you for posting your question. I hate that your friend is in this situation. Your best bet will be looking at Legal Aid of Northwest Texas. The website is as follows: http://www.lanwt.org/ They have offices in the Dallas area. Unfortunately, your friend has very few legal options available to her. Foreclosures are almost impossible to overturn and the eventual eviction is equally difficult to prevent. Usually these problems must be resolved before the foreclosure sale. Even still, there may be business solutions through which an attorney may guide your friend. Those would involve repurchasing the home or leasing the home. Depending on the circumstances, too, there could be surplus funds that can be accessed following the foreclosure sale. If so, that may be helpful in paying rent for a few months. Best of luck to your friend.
