Elder died from not eating in nursing home

More details to this question:
Hospital doc said he came in so bad his kidneys were not recoverable. No hydration or food, he was 85 lbs. And 6 foot. The nursing home said he was eating ok. This case if taken by a lawyer would be on a percentage basis on winning.
