QUESTION

How can I protect my brother.

Asked on Dec 31st, 2014 on Elder Law - Virginia
More details to this question:
My brother married a younger woman after the death of his wife. She has systematically gotten all his money and assets into her name. He is very ill and his wife has power of attorney, has control of all finances. She is now having an affair and is not providing care for my brother. At this point he wants and needs to get away from her. I am willing to bring him to my home but will need funds to provide for his care. How is best way to go about this.

You have not mentioned whether your brother is competent to revoke the power of attorney. If he is, he can revoke the power of attorney to  wife and grant you power of attorney. You can bring him to your home. With the help of an attorney, you can try to recover assets from the wife.  It sounds as if your borther has grounds for divorce. If your brother is not competent, I would suggest you contact Adult Protective Servies to report financial explooitation.  You will need some help filing a petition for guardian and conservator for your brother.
