I have POA for my alzheimer's afflicted sister. Her Pension was generous enough for her to remain for years on private pay at what ended at $5800 a month for room & board plus needed services. This gift would kick her off the county assistance she's been on for the past year and a half. What can I do for her? It's her gift.
If your sister is under 65, you can open an account with a master pooled special needs trust in your state. Due to a very recent MN court decision, you may also be able to open an account if she is over 65 if the amount is such that she can reasonably expect to receive fair market value in goods and services from the transfer.
