Our lawyer took our mother's broken-hip from negligence and elder abuse case on contingency, but now is making completely inaccurate statements in attempt to remove himself just before the hearings, and has filed "Declaration in support of attorney's Motion to be Relieved as Counsel- Civil" They refused to get a deposition from mother for 2 years and she finally died from the injuries, and now they are lying about the law, such as tell the family we have no ability to collect pain and suffering in California, whereas in reality as her heir the limit for elder abuse with reckless neglect is $250,000 not medical bills. Their real motivation for Substitution for Attorney is entirely selfish and seems to violate good faith. Should family attend the upcoming hearing where the attorney wants to be released and present the FACTS? Or, should we just give up trying to seek justice?
It appears that you and the lawyer will continue to see things differently, meaing that you need a new lawyer, one who sees things your way, not to try to hog-tie this lawyer to the case.
