QUESTION

My 70 yr old father being targeted by an opportunist

Asked on Jul 07th, 2013 on Elder Law - Florida
More details to this question:
7 weeks ago, dad started seeing a 55 yr old woman (no job, living in motel) and now she's looking to move in with him. She's already gotten $600. When they got into a fight she told 2 people that he attempted to rape her and asked for them to call police (scare tactic-she has cell phone). When he stopped calling/having anything to do with her, she left 10 voicemails stating that she's sorry and made a mistake. How do I protect my Dad? He owns home but is on a fixed income ($1,000 month). Should I put his home/truck in a trust under my 6 yr old son's name so Dad has something left when the dust settles? I was also thinking of asking for POA for all his finances. I already oversee finances but I specificially did not put my name on his accounts and do not have his bank card. Wanted to be above reproach. He would be considered capable of making his own decisions but this woman has him thinking that she's in love with him. I'm purchasing Identify Theft protection for him. that's terrible. report her to the police and put a report on file. they can't charge her. they may even speak with her. at the least, your concerns are documented with the police in the event things escalate. frankly, i would have a talk with her and tell her to leave your father alone.

A living trust would be a good idea with you as trustee. It would be best if it were a "blind trust" and your dad would not have knowledge where the accounts were. Beware that a revocable trust can be changed at anytime. The truck should be kept out of the trust in my opinion.
