Question about APS case which started with false anonymous call

Asked on May 24th, 2020 on Elder Law - New York
More details to this question:
Hello. Recently, my father was contacted by JASA (NYC) based on an anonymous phone called made maliciously by someone in his building. My father and I (30s, male) live together. My father is in his early 80s but is independent. JASA did not do any proper investigation and, acting solely based on the anonymous call, instead contacted APS, which sent a threatening letter to my father. My family and myself, are ready to defend him, as well as all of our rights and interests. We would like for APS to close the case and notify us that it was closed. We need to know what APS could possibly do regarding my father's case. Do we need legal representation? Thank You, Brooklyn, NY

While strictly speaking you do not need legal representation, an attorney who has experience with APS can guide you in your effort to get the case dismissed or at least designated "not proven."  To find an elder lawyer near you, you might use the Find a Lawyer function on the website of the National Academy of Elder Law Attorneys (www.naela.org).

This is general information. It cannot substitute for a personal consultation with an attorney. It is not intended to be legal advice or imply an attorney-client relationship.
