In 2019 my Mother applied for and was approved for long term care insurance benefits under her policy with Transamerica. At that time, a nurse stated my Mother's qualification as being needing assistance in at least 2 of the Activities of Daily Living - dressing and continence. In Feb 2020 a contract nurse for Transamerica met with my Mother and me for her annual assessment. As a result of this assessment, the nurse stated my Mother did not qualify as she did no need assistance in any Activities of Daily Living. Transamerica denied her benefits effective June 2020 and I have been fighting with them since that time to get the benefits reinstated. At the time the contract nurse did the 2020 assessment, I filed a complaint with Transamerica over the deplorable treatment given my Mother by this nurse. To date I have been unable to get copies of Nurse #1 assessment and Nurse #2 assessment. Since my Mother's health has not improved since 2019, I wanted to compare the two assessments
Please review what you have done to get copies of the assessments and whether you (as opposed to your mother) have a legal right to them. You may also want to consult with an elder law attorney.
