QUESTION

Do I have a civil suit?

Asked on Nov 30th, 2020 on Entertainment Law - Maryland
More details to this question:
I have binding side artist contract with a huge artist in the R&B Music industry. I own 100% of the publishing. The contract is established in Baltimore, MD. The artist breached the contract when they didn't show up for our music shoot in 2018. Kept the advance I paid him. The contract states that he was compensated $0 even though I paid him $25,000 to record the song and $17,000 for the video shoot appearance. (I do have evidence of the bank transfers and payments, even though the contract says $0) Do I have a case for financial recoup as well as breach of the contract in civil court or not? I want some counsel on this before I hire an attorney and also want to know what kind of attorney I should consult and contract with. Thanks for your help! Chad

Hello Chad. I'm sorry to hear of the problems that you're having. You are in Maryland according to the geographical location that was selected here. If you do plan to file suit it may be and I emphasize maybe that you may need to retain counsel in the state that the defendant resides because if you file suit, that the Jurisdiction of the court will lie where the defendant resides or where the contract was to be performed. So in what state does the defendant live, and what state was the contract to be performed?
