QUESTION

What are the reasons or when a Will becomes invalid?

More details to this question:
Brother says mom has wrote a deed on his name only. But sister and I've taken an LA, how are we to prove that the LA can overpower the Will which has no probate or any type of solemnity.

If the deed is a valid deed, then your brother is the owner of the property.

Your question does not make any sense.If your mom had a will the will controls distribution of anything not otherwise passing by law. If she gave a deed to your brother and put his name on the house and she passes.. he may own the house if it is titled in his name with some sort of mechanism that it passes by her death to him alone. What is an LA? A Deed by-passes probate, as well as the terms of the Will. Courts generally try not to substitute their discretion for the intentions of the grantor.
