More details to this question:
I'm filing for divorce in the state of Pennsylvania. I had my 401k before I was married. Can he try to get any of my 401k money. He doesn't have a 401k.

Hello, to answer your question, the pre-marital portion of the 401(k) is not considered marital property.  However, any increase in value during the marriage could be considered marital property subject to equitable distribution.  Hope this is helpful.
