QUESTION

abandonment and child support

Asked on Feb 04th, 2013 on Family Law - Georgia
More details to this question:
my son is 5 years old. He hasn't seen his father since Aug of 2011 ( almost 2 years) I have texted him, AND CALLED ...set up one meeting, which was never done, (he didn't give me a meeting time) he has provided no support, and hasn't offered. I would like to know if I can get him with abandonment (remove his rights) and have him pay back child support. He has 4 other kids, 3 he has to pay child support for, (divorce) and one that he doesn't see or pay for either. I don't want him in my sons life, since he doesn't want to be in his life. Any help, comments, or helpful advice is welcome. Again, I want to know if I can get him for abandonment, (and remove his rights) and have him pay back child support? THANKS ALL

If he goes thirty days without paying any support, it is abandonment [a crime].  If he does not pay pursuant to a Court Order, then it is a contempt issue.  If he does not pay per a Court Order for a period in excess of one year, his parental rights can be terminated if you get married and your new husband wishes to adopt your child.
