I have a question. I received a court order stating this and now on this 11th day of September 2014 the plaintiff's motion to make rule Absolute is Denied without prejudice for failure to comply with the service requirements of the Monroe County R.C.P. 206.4(c)(3) Ok, so I now know what I did wrong. I didn't know I had to have him served myself. I thought he was sent the papers. I did not understand the law. I now understand the Law. so Do I have to write the 5 original motions over again? or can I ask the court to amend the show cause date (on all 5 court orders) to begin from the day he is served, plus whatever time the judge allows for a deadline? if so, how do I write the motion to have the show cause date amended? he is in Georgia and I have to have him served by a process server in Georgia. I had this done once before and it takes time.
Refile the motions and ask for a delayed presentation date so that you have time to serve him. If there's an order already in place, you only have to serve via First Class Mail.
