I live in Virginia. I have been unemployed since December 2014. I received tax money. My husband and I separated in February because I told him to leave. He was paying all bills. He left like I requested and has not returned. I had surgery in Dec. 2014 but been in and out of hospital. I have not returned to work. We do not have any children together although I have a son by another man. Can I get Alimony or Spouse support from him? We live in VA.
Spousal support is determined by a number of factors set forth in Virginia Code 20-107.1. These include the length of the marriage and whether he supported you during the marriage, as well as the disparity in your incomes and his ability to pay.
This answer is given in accordance with the laws of Virginia and may not be applicable in any other state. It should not be construed as legal advice, as that would require a more thorough analysis of all of the facts involved in a specific case.
