QUESTION

Am I divorced?

Asked on Apr 15th, 2013 on Divorce - California
More details to this question:
My ex wife told me she filed for divorce and that we are divorced. She won't tell me where and when. She is playing games and such. I have tried some courts here in California for information but no luck. I am most certain that she filed in California just don't know what county. I don't have case number or anything just our names and when we were married and birth dates. All I need to know is that we are divorced and I can move on. I need verification for Social Security and my insurance. Thanks

If she won't tell you where, then assume you are not and file and serve her with a Petition for Dissolution of Marriage in your County of Residence.

If you have never been served with anything then you can not be divorced. She would have to have filed where she resided. If you can find no evidence that there was a filing then you should assume that you are still married.

If you have already tried local counties to find records and have found none, you can either hire a private investigator to do a more through search, or you can file yourself in the county where you live, have her served, and see if she produces documents to show that you are already divorced as her response.

I cannot tell you. You would have to check in the county where you both lived or where she lives now.
