I have a current child support order in effect with an exboyfriend. The 3 years before he started paying support I was married and never told him about the kid. The child is now 23. Can I ask for retro support for those three years he didn't know about his son? The original support did include back support but not those 3 years.
If this is a Wisconsin case, the general rule under the paternity statutes, is you can no longer seek retroactive child support relief, absent extraordinary circumstances, going back to the birth of the child. You are entitled to retraoactive relief only to the point a motion is filed with the court establishing a child support order and the person is served with papers to appear in court. How is it that you are getting any child support if the child is now an adult?
