QUESTION

Birth certificate adjustment

Asked on Oct 20th, 2012 on Child Custody - Indiana
More details to this question:
At the time of birth I was married and my wife had a child with another man. But we were still together so I signed the birth certificate knowing I wasn't the father but the biological father wasn't in the picture. Can this be amended and changed to take me off as we are no longer together.

Under Indiana law, you are actually presumed to be the father of the child because you are married to the Mother.  If you are looking to challenge the paternity of the child, you would typically do this through a divorce proceeding.  This is typically done with a genetic test.
