Can a Judge force the sale of a coop I own with my wife in NYC?
Asked on Nov 26th, 2019 on Child Support - New Jersey
More details to this question:
My ex wife is trying to enforce a foreign Child Support judgement in New Jersey.. I have requested a variation in the foreign jurisdiction as my income has gone down significantly. I work out of a coop unit I own with my wife in New York. I am afraid that a local judge might allow my ex-wife to force the sale of my coop unit and overturn the TBE we have, If I cannot afford to pay the full Child support payment. This would effectively have a terrible effect on my income which would only make things worse. How can I ensure that this does not happen?
Thank you for your question. I understand how worried you must be about your property. The short answer is possibly. A Court can enter an Order to sell property to collect on a child support obligation. But the final determination depends upon how the property is owned and whether there are other available sources to satisfy the obligation. I understand that you need answers and need to protect yourself. I strongly suggest that you schedule a consultation with a family law attorney who has experience with child support matters so that you can understand the implications for you and your family.
