QUESTION

Can a law guardian deny visitation?

Asked on Jan 17th, 2014 on Child Custody - New York
More details to this question:
my ex is telling me that our 9 year old daughter spoke to the law guardian and that the law guardian said it would be ok for our daughter to deny her visitation with me this weekend. is this allowed? wouldn't this be a violation? There is no history of abuse. it seems that each time my ex and i go to court, my daughter is somehow informed and doesn't want to see me the next day. Thank you for any help.

Two things- it may be that there is a degree of parental alienation going on; however, the only way to address it vigorously in court. If a violation occurs, report this to the court and follow up on this. Alternatively, retain an attorney to protect your rights.
