QUESTION

Can an undocumented alien apply for child support?

Asked on May 20th, 2015 on Child Custody - California
More details to this question:
My sister is an undocumented alien, married with her husband who recently left her. She has a 10 year old boy, who was born in Mexico but brought and raised here. We are wondering if she could qualify for any type of child support and if she did would it affect her in the future in becoming a US resident?

I have not seen the Family Court involve itself in immigration matters, there aren't generally questions regarding the right to be in the country except to the extent that it could affect custody/visitation (as that parent could potentially be deported, and that might be a consideration in deciding custody). I would advise talking to an immigration attorney.
