QUESTION

Can child support be waived

Asked on Nov 10th, 2014 on Child Support - Massachusetts
More details to this question:
Can parents mediate child support arrangements? In other words, it would be a better financial solution for me to waive child support and release my husband from these payments in exchange for him not going after my 401k. I will need my 401k to pay for my son's college expenses so, he will not be denied the support he is due.

While theoritically possible, most judges would not approve such a waiver in most instances.  You should also give careful consideration to whether such a waiver makes financial sense.  You should consider also that the court has the authority to order your husband to contribute to college expenses in addition to child support.
