Can children under 9 testify regarding Dad abuse?

More details to this question:
My 3 grandchildren, 9, 6 and 5 share 50/50 with my daughter and ex. Dad has for years been rough and abusive especially to son, pulling ears, poking chest, picking up by head, choking hold etc. No one believes children unless there is bruises, even then the CPS said it was inconclusive. What can be done legally?

The children's mother needs to try and get the children into counseling, so their voices can be heard in court through the counselor. Consulting with a good custody attorney can also help the mother develop a game plan and learn how to gather admissible evidence for a possible motion to modify custody.
