Can he request and Ex-Parte hearing for custody and or visitations?

More details to this question:
My son is in the Navy and just got back from a 10 Month Deployment which started in August 2014 and returned June 4th, 2015. During the deployment. he and his then girlfriend broke up. Their baby was born in January and now that he is back his ex will not give him time alone with his son because she’s upset they are not together so she uses the baby and says that she does not trust him because he does not know how to be a father yet.

She's entitled to her views but Dad and Son are entitled to each other. Dad needs to establish his rights in Family Court.
