QUESTION

Can I be emancipated?

Asked on Apr 10th, 2013 on Family Law - Nevada
More details to this question:
I am 16 years old, I will be turning 17 in August. I am pregnant with a little girl due in August. My parents will not let my boyfriend of 3 years at my house so he will not be able to be allowed to raise his daughter with me. I want to get emancipated so we can raise her together so she can know and be raised by both her parents. My boyfriend is 18 years old and is apart of the National Guard. We are looking into apartments right now and have the income in order to support both of us, as well as our daughter. I will be finishing high school in this next year as he is graduating this June. I would really like to be emancipated for myself, and for my daughter. I am been looking into it for awhile and I believe I understand the process but wanted to know if I would be eligable. Thank you for your time and I would greatly appreciate an email reply back as soon as possible. Thank you for your time.

In order to get an Order of Emancipation in Nevada, you must be at least 16, married or living apart from your parents, and a resident of the county.  You must Petition the Juvenile Court and allege certain things that are set out in NRS 129.090.  In order to get married, you need the consent of one of your parents.  Assuming the birth father is a decent guy, i.e., not into drugs or criminal activity, possible a 3rd party mediator needs to sit with your parents and you and your boyfriend to help them understand that at 18 you are free to go with your daughter, and they risk you making a choice to leave with the baby and not look back at that time.  If they want a relationship with their grandchild, they might need to change their thought process.  And your boyfriend can go to court with or without your consent to get his own custodial rights to the child.  They might prefer to have him at you home so the baby remains under their roof. Good luck.
