The marital house is in both of our names but the loan is in just mine. To protect my interests we added a divorce addendum that if he doesn't fix the property, sell or rent the property together or get the house refinanced in just his name if none of those are done he is to sign the entire property over to me, he had one year to complete one of those things. Its been 3 years and due to our sons choosing to live with him I didn't want to act upon the contract breach. He has completely destroyed the property leaving trash and debris everywhere in and out of the home. He has also stopped paying the agreed upon payments to the mortgage company. I have recently found someone who wants to buy we're moving forward and he's refusing to sign over the property or leave. What can I do and how long can it take
