QUESTION

Can I file a lawsuit?

Asked on Oct 06th, 2013 on Family Law - Pennsylvania
More details to this question:
Hi my name is JR I live in Pennsylvania and I have been going through a custody battle with my ex wife for 15 years. I have filed several contempts on her for not allowing me to exercise my partial custody rights and nothing is ever done about the contempt. The contempts are put on the back burner By doing that it gives her the opportunity to do it over and over again. I have paid out lawyer fees in the amount of $4000 for a contempt I filed almost 3 years ago I haven't had a hearing on it yet to this date. Due to the stress that The court system, judge, ex wife, and lawyer put me through I now suffer from a terminal illness. My question is can I Sue them? Thank you JR.

First, you should find a lawyer who will get you results and not make empty promises. That being said, if your lawyer has not done the work you hired him to or missed deadlines, etc., you can sue him for malpractice. You cannot sue the judge--he/she has immunity. You probably also cannot sue your ex unless you can prove that she has intentionally caused you emotional distress.
