I am not sure exactly what you mean when you say that you have a lawyer. In order to properly answer your question, I would need to know whether you signed a written retainer agreement with the lawyer, whether you paid him any money, and whether he has filed anything with the court (not just for child support).
If he has not filed anything with the court, you could file for child support yourself. (Of course, if you have paid the lawyer any money for the child support application, you should request a refund).
As I am sure that you know, you have a much greater chance of success if you have a lawyer. What people don't realize is that, even know they can save money without a lawyer, they will often lose more money if they don't do things right. Therefore, in most cases, a lawyer is a good "investment."
I recommend that you at least borrow enough money for what we call an Assessment, in which I will go over your situation in detail, answer your questions, and give you guidance as to the best course of action. Typically, the Assessment lasts about an hour. The cost is $425.
