Can I file for full custody of my two children, ages 3 and 1, since their father has been in prison for almost two years?

My kids' father has been in prison for almost two years, this is his second bid of doing 2 years in 5 years. He was charged with his 5th DUI and a gun felony charge.

You can file for full physical custody. They will likely grant him visitation if he had any contact with the children before his time in jail. The court may even grant you full legal custody, but I would ask your lawyer.
