QUESTION

Can I get an annulment

Asked on Nov 09th, 2019 on Divorce - New Jersey
More details to this question:
I am having marital issues with my wife of 1 1/2 years. She's an immigrant that's here on a visa that has expired. She's trying to use an excuse that I'm being mentally abusive (her reason is that I've mentioned calling immigration) so she can stay here in the USA regardless. I want a divorce after realizing I married someone with a mental illness. I had no idea until after we got married. She's bi-polar. She's very clever. Can I get an annulment under those circumstances? I was considering calling immigration to tell them how abusive she is and that her visa has expired.

Thank you for your question. I understand how worried you must be about your family matter. The short answer is possibly. Grounds for a New Jersey annulment are: Bigamy, Duress, Nonage, Incapacity, Impotence, Incest, or Fraud. An example of fraud is that one spouse is an immigrant and uses the other spouse to stay in the country. I understand that you need answers and need to protect yourself. I strongly suggest that you schedule a consultation with a family law attorney who has experience with immigration as soon as possible, so that you can understand the implications for you and your spouse.

Maybe. Depends on how your marriage was formed and your wife's mental state and intentions from the start. Edward Zohn, Attorney at Law, 908.791.0312
