QUESTION

Can I get full custody if I was never married? How?

Asked on Aug 25th, 2015 on Child Custody - Wisconsin
More details to this question:
I want to make sure that I have full custody of my son. His father and I were never married and until just this past month finally had the court case for child support. He never contacts me to see about his son other than today when he has threatened to take me to court for custody of him. My son doesnโ€™t even know him he has seen the child a total of 1 week 3 hours and 5 min the entire 2 and half years that my son has been alive and I donโ€™t want him to have any visitation with him at all I fear for me and my son. He refuses to sign over his rights. What can I do?

If he files at the court for visitation, you will have to explain your side and why you don't believe it would be in the child's best interest to have any visitation with his father. That will be difficult, as usually the courts want children to see both parents (at least sometimes) unless the child would really be in danger while visiting with their other parent.

First things first: HIRE AN EXPERIENCED FAMILY LAW ATTORNEY. That said, there seem to be two routes to follow. The lawyer you hire is likely to advise you either to insist on supervised visitation, if any, between the father and the child. Or s/he may suggest you petition for Involuntary Termination of the Father's Parental Rights. You might have a good case for it, and if you prevail, then he is, or should be, out of your life and your child's life.
