QUESTION

Can I get the full custody for my daughters?

Asked on Feb 19th, 2012 on Child Custody - North Carolina
More details to this question:
I am wanting to get my children's father rights to be taken away from him. He is abusive and has an alcohol problem. I currently have charges out on him now for hitting me, we have had domestic issues before that are on file. He has broken into my house with my children here and held me and my daughter down on the floor until the police arrived. my oldest daughter is afraid of him and will not have any thing to do with him as is my youngest he also shows no intrest or desire to spend any time with them. I ask him to come see them the time and he doesn't. I have dozens of t messages to prove this, he does pay child support but I am willing to drop this so I can have full custody of my girls. Is this possible or not? He also has a long felon criminal background with assults on females gun charges and drug charges compared to my clean record

Domestic violence is a serious issue. A person's safety is always our greatest concern in these situations. In custody situations, the North Carolina court's look at what is in the best interest of the child to determine where the child should live and whether or how much visitation the other parent should have with the child. Courts do consider criminal records and domestic violence in making these decisions. I would suggest you talk with an attorney about the particular facts of your situation. Generally a person can give up their rights as a parent and they can and sometimes do this in order to avoid making child support payments.
