Can I move her and the child with no issues?

More details to this question:
We live in different states. I don't want to get caught up in legal issues. She told me before we got married that the child's fathers name wasn't on the certificate but it is. He's not in the child's life and hasn't signed the certificate. The state put him on there when she filled on child support which he hasn't paid. He owes the state $3,000 and the child $5,000. The state can't get in contact with him to serve him. She wants full custody and I want to adopt the child. I know where he is living and says she tried to get to get him served but the state can’t get a hold of him. It's a mess.

I have no idea from your question what your relationship is to the child. If you and the mother are married, you can file a second parent adoption and the father's termination of parental rights would be a part of it. Since the father does not have a parenting plan, the mother is free to move with the child. The mother has custody, since the father has not filed anything to the contrary. If you have an address for the father, you should give it to the mother and she should give it to the State so they can serve him.
